A marriage-based green card allows the spouse of a U.S. citizen or green card holder to live and work anywhere in the United States. The difference between conditional and permanent residence marriage is that a conditional marriage-based green card is issued if the marriage is less than two years old. A joint USCIS marriage petition is necessary to lift the conditions and achieve lawful permanent residence through marriage.

Eligibility requirements for a spouse green card application include a valid marriage, a spousal petition of a green card holder or a U.S. citizen, and the ability to support the immigrant spouse financially (Form I-864). Of all green card application options for spouses already in the U.S., adjustment of status (AOS) is the most suitable marriage-based permanent residence route.

Adjustment of status services are for spouses who are already in the United States legally and want to apply for their green card without leaving the country. However, if the foreign spouse wishes to travel abroad during the marriage-based green card processing, he or she can seek Advance Parole. This is a travel document obtained by filing Form I-131 that, when approved, grants the immigrant spouse to travel abroad and return to the U.S. without abandoning their marriage-based green card application.

Take note that an immigrant spouse petitioning for AOS should not leave the U.S. without an Advance Parole. This document will be presented to the CBP officer for hassle-free port of entry admission. Also, this travel document is only issued by the USCIS service center and not a USCIS field office.
